When someone passes without a will, who gets his property.
Question Details: My father passed without a will, everything is in his and my moms name except a boat and cottage in canada. Do we have to go through probate for those two pieces of property. My mom just wants to sell them.
Is the cottage & boat in just your fathers name alone or is it jointly held? If it is jointly held, that should be an easy process in Canada.
