When someone passes without a will, who gets his property.
Question Details: My father passed without a will, everything is in his and my moms name except a boat and cottage in canada. Do we have to go through probate for those two pieces of property. My mom just wants to sell them.

Is the cottage & boat in just your fathers name alone or is it jointly held? If it is jointly held, that should be an easy process in Canada. If it is in your father's name alone, a probate estate may need to be opened in Canada. You need to contact an attorney in Canada to see what needs to bne done there.
