Can an employer reduce your work hours after you return from maternity leave?

Question Details:

When I returned from maternity leave my employer only had 8 hrs. a week for me to work; I used to work 40 hrs. but the new girl kept my 40hrs. Can they do this?

Pursuant to the Family and Medical Leave Act (FMLA), when an employee returns from leave under the Act, the employee is entitled to be restored to the same job the employee left when the leave began.  If the same job is not available, the employer must place the employee in an equivalent job with equivalent pay, benefits, duties, and responsibilities. Under the Act, employers are prohibited from discriminating against or interfering with employees who take leaves.

The same holds true for California Pregnancy Leave (PDL), the company must allow you to return to your previous position or a position that has similar pay and responsibilities.
