Question Details: I found out a few months ago that my brother & his wife are renting the house. They never contacted me or have offered me any money from the rent they've received. My other brother has received some of the rent money, but he also feels sleighted. This development has caused some hard feelings for me & I have asked them to buy me out so that I don't need to deal with them as business partners. They keep telling me that they'll think it over & get back to me. I am a student with a lot of student loans & don't want to spend a whole lot of the estate money paying a lawyer to settle this matter.
I am not admitted in Hawaii. Did you probate the Will? Was the deed transferred? Is it in all your names?
Your brother owes you and your other brother some money. If, however, he has been maintaining the property and paying the taxes then he is entitles to take that which he has laid out.
Send him a certified letter asking him to buy you out. Tell him that if he doesn't respond within a certain time that you will seek court help to partition the property. This means you will ask the court to split it equally but really what happens is that the court orders it to be sold and then divides the proceeds equally.
