Question: Criminal Defense - Virginia

Asked on 11/4/2009

Must a witness who is subpoenaed testify?

I was subpoenaed to go to court to be a witness but I don't want to answer all the questions. I don't know if they will try to twist my words around and have me end up incriminating my husband.

Well, you are required to be there and take the stand and answer all questions asked of you. If you feel you won't have proper representation by the lawyer in the case representing the estate (?), then perhaps consider hiring your own attorney to protect your interests.  Unfortunately, twisting of words does happen but that is why you have the opportunity to explain yourself or the events while on the stand.
