Question: Divorce, Marriage, Alimony - Ohio

Asked on 9/15/2009
When an unmarried couple with a child separate, how do you go about dividing possessions, house payments and child custody?
My girlfriend has a child with her ex-boyfriend. They were never married. They have a mortgage together, utilities are in her name, and they have not pursued legal custody options. He has become impossible to deal with. Is there a legal way to get her name off the mortgage and utilities? She had made the majority of the payments over time. He lives in the house and she has moved into her own apartment. He let's payments go months unpaid. He has many of her possessions at the house with him. He is becoming verbally violent which is bad for her and her child. Where should she go for legal help

AttorneyPages has verified that this person is an attorney.

To get her name off the mortgage, she will have to file a partition lawsuit in civil court. Custody defaults to her without a court order. Any custody issues would be settled in either juvenile or domestic court depending on the county. If she is not living in the house, she should cancel the utilities and have them shut off after giving her ex notice. Verbally violent is nonsensical and not recognized by the court if it doesn't meet the criteria of threatening or harassment. For legal help she should contact an attorney and if she cannot contact one then she needs to educate herself to file pro se.
