What should I do if a collection agency is trying to collect a fraudulent debt that has been deleted from my credit report?
Question Details: I was a victim of identity theft and had several credit cards opened under my name. The only one I had problems with clearing the fraudulent charges was with a computer company. Eventually, the crdit reporting agency deleted the charge from my credit report. Now, almost 4years later, a new collection agency is attempting to collect the debt. Is this valid? How can I resolve this?
If you were the victim of identity theft, and you have the proper evidence to support your claim, then you can submit that information to the credt bureaus as well as the new debt collection agency on the claim that the debt is invalid and does not belong to you. Under the Fair Debt Collrction Practices Act, the collection agency has thirty days to attempt to verify the debt as belonging to you, and if they cannot, then they must cease all collection efforts on that debt.
