What's the recourse for the person/s filing False Charges on an Individual, as well as Verbal Elderly Abuse.

On10/29/2009 the elderly person 75 yr.old home-owner was outside the neighbor's son 48yr.old habitual criminal(13 Arrest) the 75 yr old spoke to the 48 yr old the 48 yr old proceeded to use abusive & threatening language,the 75 yr old went to his truck in his driveway got his Licensed weapon and put it to his side and went inside his house. The 48 yr old called the police & made a false report stating the 75 yr old put the gun to his head, the female outside with the 48yr old told police she never saw a gun.The 75 yr old has been in the hosp.since the incident resulting in 2 Heart Procedures
