What rights does a new employee (3 months)have regarding pregnancy leave if the firm they are working for has approximately 25 people?

Question Details: I was let go from my old firm the end of June and I was 4 months pregnant. I am now looking for a new job and have found one I am really interested in but am wondering about my rights to pregnancy leave. I know that FMLA allows for 12 weeks of job protection but was told that doesn't apply if the firm has less than 50 people. Is this correct?

Yes, this is correct.  If the employer has fewer than 50 employees, it is subject to the discretion of the employer.
