What rights do I have to decline a **** screening test?
Question Details:
A room in my home allegedly smelled of marijuana during a visit from the foster care agency (had 3 foster kids). I am now being investigated (two children) and they want me to take a **** test at one of their facilities. FYI am going to private physician to get screening done for the record.
I don't think it much matters, whether or not you have a right to refuse the test, or to have it done at your own doctor's office. If you don't make the agency happy, they are going to pull the children out of your home.
Children get special protection from the law, because they can't protect themselves. Children in foster care are wards of the court, and their best interests come before most of your rights; you're being paid to take care of them, by the State, and that has something to do with the legal analysis, too.
