Question Details: We are still married and things are fine except that when she goes to her moms she'll stay all weekend knowing I want my kids home and allowing them to go places that I don't totally agree with......Does the grandmother have any right to our children and how much do I actually have????????I live in Florida.....
In the State of Florida grandparents do not have any rights in a family law case. It is different if there is a dependency action pending. As a father you have just as much rights to the children as the mother does.

Im Florida, you have equal rights to your Wife regarding the children, and grandparents do not have any rights, except for those voluntarily given to them either by your Wife or by you. However, until there is some sort of specific time sharing schedule in place that determines who is to have what time with the children, there is really nothing that you can do as it is considered a civil matter that would need to be resolved by the courts. And, even when there is a time sharing schedule in place, during her time with the children, she can pretty much do what she wants, so long as it is not something that is detrimental to the children or endangering or neglecting them in some way.
A specific time sharing schedule, along with any appropriate limitations on what either party may or may not do with the children or allow the children to do, would be established during a divorce proceeding.
