Your state income tax refund is treated like any other income--it is not specially protected. Taking a quick look at MI law, it seems like at least 25% of income can be garnished; I say 25% because some of the readily available sources suggest that up to 40% can be garnished. In any event, you should anticipated that a creditor can reach at least 1/4 of your state income tax refund.
