A family member plead guilty to 1 count F4 theft for stealing $120k from her employer. She was given probation. While on probation she stole from her new employer (60K) and was charged with three F3 counts (2 theft and 1 computer crime). We have been told a plea bargain is likely but are unsure of what to expect the plea bargain to be. Should she expect prison time or is it more likely they will offer some sort of home detention?
You should be asking this question of the lawyer representing the defendant, and the lawyer might feel it's not appropriate to give you the answer. As a second offender, with a $60,000 theft while on probation for another theft, I'd plan for at least a year in prison, and hope for home detention. Some of the things that will go into the decision will include how cooperative the defendant was, once she was caught, and if she has returned the money or at least some of it, and possibly the new (former) employer's feelings on the subject.
