What is the legal way of claiming defamation of character?

Question Details:

My daughter has been going through a horrible time with one of the "popular" girls claiming she has Aids. My daughter has been in counseling, had problems with cutting herself, and has had an emotional breakdown. She of course is very negative and even felt she had to give bloodto prove her innocence. This rumor has been continued now for 2 years and has spread to 3 different counties. I refuse for this lie to continue and cause more pain in my daughter's life. I am taking action and need to know where to start.

There are special rules with regards to sueing minors. I have not dealt with those rules in a long time and off the top of my head do not recall them. You said that you are now going to "take action," but you didn't elaborate on exactly what that is. I assume since your asking for legal advise that your going to take legal action. If that is the case and you are intending on suing, then you will need an attorney. You can look in the yellow pages under Attorneys and find some that advertise Defamation. You can also call the South Carolina Lawyer Referral Service at 1-800-868-2284.
