Question Details: My son was riding in car with 3 others when police pulled car over for speeding. Search found one of the other young men had marijuana on him - less than 1 ounce - so everyone in car was charged with possession. What kind of sentence will my son get for this?
Marijuana less than an ounce, then Misdemeanor or public works up to 12 months. OCGA 16-13-2(b). In your son's case would need additional facts but it sounds like the marijuana didnt belong to him, and if thats the case he should fight the case.
They have to prove that he knowingly had direct physical control over the marijuana at any givin time to actual posses it, but it doesnt require that the substance be on him.
