What is fair pain and suffering?

Question Details: I was in a auto accident that totaled my car in which the other driver was determined to be at fault. I had no loss of wages or major injuries, just the inconvenience of dealing with a rental car and shopping for another vehicle. The only exception would be a big bruise on my left arm that went away in a few weeks. The insurance company offered $1500.00 pain and suffering for this bruise. It seems to me that the inconvenience of the accident is worth more but I guess no dollar amount is usually applied to that. Is this settlement offer reasonable? I am nervous signing.

I am a lawyer in CT and practice in this area of the law.  You are not in a position to settle yet.  i suggest that you hire a car accident lawyer in Oregon to get involved to help deal with the insurance company.  i also suggest that you go to your primary care physician and ask him/her whether any further treatment is necessary.  you need to know what the extent of your physical damages are before you settle.  Also, a laywer will be able to help negotiate a deal for you here.  In my experience, 5K-7K is where you should settle this sort of claim.
