Pennsylvania has taken the position that a person’s Blood Alcohol Level (BAC) and the number of times the person has committed a DUI will dictate what punishment they will receive.
A first offense with a BAC is .08% to .099% is an ungraded misdemeanor. The penalty is a 6 month maximum probation; a $300.00 fine; required CRN, AHSS and possible D&A. There is no loss of license and no jail time with this particular category.
