Question Details: A company's employee acted unprofessionally, and attacked me on the basis of mistaken identity. I am now legally blind due to this attack, my doctor says I will not see again. They say the best I can get is 75,000 they have taken this figure from 1970. I'm in Canada.
These awards are highly subjective and context dependent. They are affected by your age (how long you'll need to suffer from the injury), by any pre-existing conditions, by your employment and lifestyles (what are you giving up), by how much residual function you have left (many people who are legally blind can still function in most capacities), etc.
That said, $75k sounds low. Who is saying this is the best you can get--the employee's or the company's lawyer, or their insurer, or the insurer's lawyer? They have an incentive to lowball you.
If it's your lawyer who says this, ask him or her to back the opinion up with cases from the last few years. If your lawyer can't find recent back up, he or she may not be a very good lawyer for this case for you.
