What if we BOTH miss our hearing to finalize the divorce?
Question Details: My wife filed for divorce (Washington state), and I signed the papers indicating I do not contest. Since filing, we have started the reconciliation process and see real hope for the future. My wife (the petitioner) is currently out of the country and will not be present for the hearing to finalize. What will happen if neither of us show up for the hearing? Will the judge issue a ruling, based on the original no-contest filing? How can I postpone this ruling until we have more time to reconcile?
If no one shows up on the day you set to finalize the divorce, the judge will probably not proceed. I cannot guarantee that, so it would be best for you to be at court when scheduled and tell the judge the case status; he'll probably enter an order that the final papers couldn't be entered without the petitioner being prsent, and hand back the final orders - tell you to get a new date when she returns. You appear to live in King County, so with my experience there this is probably a good answer. Good luck
If there is time before the hearing (otherwise go yourself),you both should write the judge and ask for a specific date to continue the trial to--long enough off to give yourselves time to work out or not. The judge probably will not move it off past a year,but ask for that and that he just notify you both of the new date by mail at your addresses.
