What happens to federal government obligations in a personal bankruptcy filing?

Question Details: I have a substantial non-tax obligation due to the Dept. of Treasury. They are currently offsetting 15% of my monthly social security payment to pay back this obligation. I would like to know if this obligation is set aside in a chapter 7 personal bankruptcy filing. Thank you.

Bankruptcy Law Answers

It's impossible to say, without knowing more about your obligation than you would want to put in a question here.  But I can all but guarantee that there is a section of the U.S. Code that deals with it, and I'd expect that section to make your obligation exempt from discharge in bankruptcy.

If you want to pursue this further, you'll need to have your case reviewed by a local bankruptcy lawyer, for reliable advice.
