What happens if I do not reaffirm my mortgage when I file bankruptcy in Florida, and then I can no longer make payments down the road?

Question Details: Will the bank foreclose on the home and will that foreclosure go on my credit report at that time? Since the mortgage company will no longer be reporting my payments, will they report the foreclosure or will it just be on my credit report as part of the bankruptcy?

Bankruptcy Law Answers

If there is a foreclosure, and you have not re-affirmed your mortgage, it will not be listed as such on your credit report.  You are, however, correct in noting that the bankruptcy will appear.
