A police report is filed after a person is arrested. assuming that the person is not held in jail, the person arrested is released with a document that includes a court date to appear.  the court then receives notice of the court date and a file is se up for the state's attorney.  the state's attorney then reviews the file and determines whether the police officer's report justifies the crime that is charged.  the person arrested is required to then show up for court on the court date and the state makes an offer/plea agreement.  the accused than then choose to accept or reject the offer.  if th accussed accepts the offer, he can plead out and the case ends with a fine or jail time being imposed.  if the accussed wants a trial, the court will set a date.  the accused should hire a lawyer if the charge exposes them to a crime that is a felony.  if the accussed cannot afford a lawyer, they should apply for a public defender.
