What forms do I need to fill out if we want to move out-of-state with a child?

Question Details:

We plan to move across the country this summer and have custody of my stepson. His birth mother is incarcerated for a long term but we have an old parenting plan giving her visitation. What forms do we need to fill out to make this move and in what order do we file them. Can we serve her the notice ourselves or give it to someone working at the jail?

You must serve her with an Intent to Relocate, which is a pattern form in Washington State.  It must be received by her at least 60 days before the planned move, giving her a chance to object to the move.  i she doesn't object you can go.  However as a part of this you really should protect yourself and update the parenting plan, addressing (1) the move, (2) the fact  that she hasn't seen the child for quite some time, and (3) her extended future absence due to imprisonment. At least call an attorney for a consult!
