Question Details: I gave my employer notice that i would need to cut back on hours and the next day they told me to either work the full time or go home. I had to be at home to take take of things So i went home. I was not going to start cutting back on hours for a week or so but they didn't care. Now they are sending my a notice of breach of contract. what does this mean and what should I do or expect?
Technically, "breach of contract" would only apply if there was a contract between you and your employer--either if you were an independent contractor, or if there was an employment agreement. If there is a contract that called for you be onsite certain times, or work a certain amount of hours, then you are in breach and they could terminate the employment and/or sue you for the breach.
However, if there is no contract--so even if they are being inaccurate in how they are describing it--an employer is under no obligation to let an employee set his or her own hours. If you do not work the hours the employer indicates, they may terminate you.
