What can i do when i was hit by a driver and he refuses to pay?

Question Details: I was driving down a road in PA and was hit by a driver who admitted his fault. The state police were called. The insurance card the driver had expired. The offier never questioned that. The driver refuses to pay so now i am out the deductible to get my car fixed. The driver walks away without paying a dime. Not a ticket for driver wreckless or driving without insurance. The repairs cost $1500.00. That may not seem like a lot but it is to a single mother on a fixed income. The deductible is something that is not accessable that easy.

You could sue the other driver. However, if he doesn't have insurance, he may not have other assets, so it may be difficult to collect.

The problem is, if you retain a lawyer to help you, there is a good chance you will pay as much or more in legal fees than you actually collect.

If you feel up to it, you could try suing him in small claims court; that is much cheaper, and you could do it yourself, without an attorney.
