What can I do to get my daughter back from her father?
Question Details:
Me and my ex-boyfriend have two kids together. We were never married but he is on both of their birth certificates and signed affidavit of parentage for both of them. I recently broke up with him and because of that he has refused to return our oldest daughter to me. He told me that because I don't want to be in a relationship with him that I'm not going to get her back. I have an appointment with my child support case worker on the 17th of November. Is there anything that I can say to her that can help me get my child back? I want to go to court for visitation and custody. Please help!
I do not know all the facts or background of your case, but I cannot understand how your boyfriend can be allowed to take your daughter away from you. Unless you are an unfit mother, your boyfriend has no right to take your daughter away from you. In fact, in some jurisdictions, he would be guilty of kidnapping!
I don't know why you are having to go to a child support case worker to get your daughter back. But I would advise you to get a family law attorney to represent you and your legal interests. I would also recommend that you go to court and work out a custody and visitation agreement so you can avoid future problems with your boyfriend. Do this as soon as possible so that you don't jeopardize your relationship with your daughter.
