What can I do if I was charged with obstruction and disorderly conduct? While at a friend's house and I was tazed over 12 times while on the ground.
Question Details:
On October 2nd I was in Carroll County, Ga, at a college party. I was drunk and the cops came tazed me. I went to the ground and they continued tazing my neck over 10 times, my chest twice. They said that I resisted arrest but didn't get charged with it. Then they said I was drunk but my blood alcohol content was not on my ticket.
Two things. One, with all due respect to the lawyer from CT who told you that you need to get the charges against you dropped if you are going to assert a claim against the police......He is right to the extent that it would certainly help you with asserting that claim. But please understand that even if you do not get them dropped, you can still go forward with a claim. Secondly, since this happened in Georgia, you need to go back and re-post your question under that state. You posted it under South Carolina, and lawyers are licensed in specific states. You need for Georgia lawyers to see your question. One last thing. You don't have to answer it, but I'm just curious. If you were tazed 12 times, wouldn't that require 12 different tazer guns?
I am a lawyer in CT and practice in this area of the law. police officers are not supposed to use more force than is required to place a person in custody. Were there witnesses? If there were witnesses that can testify to the incident you may have a good case. However, you need to get the charges against you nollied (i.e. dropped) if your are going to assert a claim against the police. the claim you are filing is what is called a 1983 civil rights violation. i suggest hiring a lawyer before you have to go to court on the criminal charges.
