In these kinds of cases, the primary insurance is normally the responsibility of the owner, not the driver.  Therefore, if the owner has no insurance the vehicle is not covered for any damages caused by someone driving the vehicle.  Some insurance policies allow for a secondary coverage, or insurance owned by the driver there is no insurance on the vehicle.  In addition, there is a possiblity that if the authorities investigate the accident, they may demand that the owner show proof of financial responsiblity (get insurance) or the owner's license and vehicle registration could be suspended or revoked.
