What are the chances of a felony assault charge getting dropped against me?

Question Details:

I was having a discussion with my neighbor and mentioned the squatters living in their home. One of the squatters ran out of the home and onto my property. She hit me in my head. When she hit me I lifted my right arm to protect myself and ended up hitting her in the head with my cane. She was bleeding. After that shekicked me in my ankle (the reason I use the cane). It ended up getting infected. The police came and arrested me for felony assault; they did not place any charges on her. I have never been in trouble in my life. This is the second time they have assulted me. The last time they broke my ribs blackend my eyes and bit me. The cops made no arrests for that.

It sounds like you have what is called a justification defense to the charge.  In any event, circumstances probably exist to help the DA offer a plea deal.  I am a New York criminal defense attorney.  Give me a call if you would like to discuss the situation.  It would be my pleasure to speak with you about the case.   Darren M.
