Question: Divorce, Marriage, Alimony - Georgia

Asked on 10/8/2009
What are my rights of possession of items that my wife gave me over a year ago when we were evicted due to her unemployment and lack of income?
What are my rights with personal posssesions that my wife gave to me over a year ago to help me get my own place when we were evicted because of her not working for over six months? Now out of nowhere her father wants these itmes back with two days notice. At this time, I'm not prepared to relinquish these items as they are essential to my everyday life (bed, television etc.). I currently live in the basement of a privately owned home, and my landlords, who reside here as well, are aware of the situation. Is there anything we can do to stop this?

Marital assets are generally divided equitably between the parties.  It may mean that you will have to sell the items and split the proceeds.  Or, you may have to give her items of equal value - if her father is demanding these items back, perhaps they were hers prior to the marriage?  Or they were gifts to her from her family?
