Determinations are always made in "the best interests of the child." Now, do you mean that you do are not the parent with physical custody of the child in that the child does not live with you on a regular basis? Because that is different than having joint custody of the child and your agreement or the court order will govern those rights. Please read your agreement. Good luck.
