What are my options if I got into an accident, with no insurance, and I'm not at fault?
Question Details:
I was involved in an auto accident. I did not have insurance but, according to the police report, the accident was ruled his fault. His insurance company told me that they are not paying for anything for my car, because they ruled it my fault. Are they allowed to do that? What are my options?
You can sue the other driver. A court verdict is the only absolute answer to who was at fault or not. The police report will help you, but it isn't automatic.
The insurance company will have to hire a lawyer to defend your lawsuit, and they might then decide it makes more sense to just pay for your repairs, depending on whether or not it looks like you'd win. The insurance company is in business to make money, and that means they will always look for the cheapest way out of any claim. If they think they can get away with just saying no, they will try it.
