We bought a used motorcycle but still haven't received the title; what can we do?

Question Details:

We bought a used motorcycle from a business in March 2008. We financed it through another business with just our signature. We have yet to receive a title. We stop in the business often to inquire about the title but they always come up with some excuse. We've been paying on this motorcycle for almost two years and we don't have any papers on it to show that it's legally ours. How can we get the business to give us the title?

It is the obligation of the dealer to provide you with the title to the car when you bought the bike as a result of your payment of the purchase that you and the dealer agreed to.  the fact that you have not received the title is a big deal and questions whether the dealer had the right to sell you the bike in the first place.  In other words, if the deal cannot produce a title to the bike, it may not be the one that owns the bike and does not have the title.  If the dealer lost the title, there is a clear remedy to this problem.  The remedy is that the dealer fills out a piece of paper indicating that the title was lost and the DMV will recognize this.  you need the title to register the bike; no?  I suggest that you hire a lawyer to send a letter to the dealer threatening suit if the title is not produced in 5 days and then file suit absent a resolution that result in you getting the title.
