Question Details: My husband and I are filing for divorce ourselves and he is a federal govt employee. His retirement in under FERS and we need to file a QDRO. We have an attorney that will prepare the document but I'm not sure how/or where to add it in the document. My husband is in total agreement with this.
You need to get the divorce, first, with a decree ordering the division of the FERS account by QDRO on whatever terms you've agreed to. The decree will need to specify the end of the period for which the account is subject to division, if you want that to be something other than the decree, and then the QDRO gets prepared after that, submitted to the court and signed by the judge, then filed with FERS.
QDRO's are very specialized documents; quite a few of the attorneys who prepare them make most of their living doing little else.

Are you a lawyer?
