What constitutes an arrest that will appear on your record?
Question Details:
I'm trying to understand how deep of trouble a friend of mine is in. She was cuffed, brought down the police station, fingerprinted, and got a mug shot for suspicion of driving under the influence. She was administered a breathalyzer, and the police said she was twice the legal limit. But they released her (a friend picked her up), and she was given a citation for running a stop sign (which was what originally prompted her getting pulled over). Was she arrested; is this on her record? I'm so confused. I called the police department but they said that they could not give out any information.
I know that these situations can be confusing. But you're not the one who needs to understand it, it's your friend's business. That's why the police wouldn't talk to you. Before you make another call like that, if you insist on doing it, I'd make very sure that your friend is okay with it first.
Your friend might still be charged with DUI; she might get the paperwork in the mail or she might be served in person by a police officer. If so, she should get a good lawyer to represent her.
It's also possible that, for whatever reason, the police may have decided not to charge the DUI, although at twice the legal limit, if that was really what she tested, it's a result that would puzzle me.
Exactly how this all will show up on your friend's record will depend on what the police filed, officially. She'll have to check her record, and it doesn't make sense to do that until whatever charges end up being filed get resolved.
