Wage Garnishment

Question Details: There is a court ordered wage garnishment that started in September for a loan we had against our Trooper. I understood that by them pursuing the garnishment they could not take the Trooper, which they did. And are still taking the money from my paycheck. My employer says they can't not do the garnishment because then they will get in trouble. Is there anything I can do?

I am a lawyer in CT and practice in this area of the law.  The creditor may take the trooper and sell it to obtain the fair valu of the car to repay the portion of the loan and are able to go after you for the balance of the loan that is due. the loan documents will govern the repossession of the trooper.  if the creditor took the trooper and is trying to get full value of the loan, i do not think this is proper.  i would go see a lawyer and bring all the loan paperwork and the judgment and the garnishment.  Most lawyers will meet and consult with you for free the first time.
