Question: Criminal Defense - Florida

Asked on 9/8/2009
Violation of non-felony probation due to behind on cost of supervision.
my fiancee and I are on 12 months probation for a misdemeanor offense and we are a little over a month before the 12 months is over but due to the hard times we are experiencing finding a job we have been behind on our cost of supervision. We have done everything else we were suppose to do and now our probation officer is saying she is going to violate us. If she does this what will happen? This is the first time we have been in trouble.

AttorneyPages has verified that this person is an attorney.

Most judges will not violate for financial reasons without first holding a hearing to determine your financial ability to pay the costs.  Good luck.
