How do we claim back due child support and heirship rights in our deceased father's estate?

Question Details:

Our estranged father just died in California. The state has been trying to help my mother collect unpaid child support for years. Approximately $76,000 to be specific. Now, the state is saying there is nothing they can do. We are also his heirs though he was remarried. We were listed in the obituary as his children even though we had no relationship. What should we do? His widow is trying to withhold info and seems to be asking my mother some strange questions, like were we ever adopted by my mothers husband, did she sign any waivers, etc?

Since your father died a resident of California, you need to contact a wills and estates attorney in California.   California law will be applied and determine what rights you may have to the estate.
