Underage DUI, 20 yrs old, blew a .065, Washington State, what am I in store for?
Question Details: This happened last night and I'm already in the process of getting a lawyer. But I'm just wanting to know what I'm in store for. Does my case that I am 20, blew a .065 which is below a .08 but yes is above the .04 law for a minor. Do these facts help my case? Unlike someone who would have blown over a .08? Thanks for helping.
A: You are .025 over the legal limit for your age. This is better than the average WA BAC for those over age 21 of .13 (.05 over the legal limit of .08). But that's not how the prosecutors think more important facts are how close you are to your 21st birthday and the general concept that you still generally very low (i.e. very little use of alcohol). If you pass an alcohol evaluation and there aren't any bad facts about your driving you should come out with an ok deal.
