Under what circumstances are auto Insurance companies able to put multiple vehicle damages into one claim?

Question Details: DUI driver runs stop a sign & hits a parked car which stops his car then, while fleeing, he drives across the yard & hits my car pushing it into my daughter's car. My insur company says that damage to the 3 cars, street signs, yards, etc are 1 claim & costs can't exceed his $10,000 property damage limits. They say first they recoup the repair costs then rental/towing fees and whatever is left of the $10,000 would reinburse for deductibles, etc. Repair costs for the 3 cars are just under $10,000 with my car sustaining the greatest damage (>$5000) Police have said it was 2 events/2 claims.

Auto Accidents Law Answers

Without knowing a bit more of the factual details, it's hard to say whether the police are right, or the insurance company.  Both police officers and insurance adjusters often act as if they know the law very well, but sometimes either one can be very sure of himself -- and wrong.

I'm not a Florida attorney, and it's also possible that your state's law might have something unique that relates to this.  I'd suggest talking to a lawyer in your area about this;  it isn't at all unusual for a letter from an attorney to persuade an insurance company to "reconsider" its position.
