What to do if the estate of my wife's grandmother is pushing to sue us for monies owed that we borrowed years ago?
Question Details: In all either my wife or us jointly borrowed money to purchase vehicles. The remaining outstanding balance is about $8,500.00 and the last payment that the estate has record of us making is about 5 1/2 years ago. We have not made any additional payments due to having a low income and after all necessary obligations are met there isn't anything left. Due to lack of additional income there is no way that we can even hire a attorney to represent us in this matter. We need to know is there any options we can pursue, including requesting that the debt be dismissed due to the statute of limitations was nearing prior to the estate having an attorney contact us about the debt. I realize that since I did respond back to the attorney that the clock could be potentially be reset. Can we request for a reduced amount or payment arrangements? I did offer a $50 per month payment arrangement to the Estates attorney, but the personal rep rejected it. This $50 would be pushing our budget but I was trying to avoid this getting to court.
they can reject payments. it is all due now. thet statute for filing a lawsuit against you is at least 6 years. have you considered bankruptcy as a way to eliminate this debt and others?
