the other driver has an expired license that I'm involved in an accident with. is it his fault even if the accident was my fault
Question Details: I am driving my friends car, he was not in the car. he let me take his car, I am not on his policy. he has full coverage insurance. I'm at a stop sign, making a left turn to go south bound on street A. other party traveling north bound on street A with right turn signal on. Traffic is clear to turn, so I slowly enter intersection to make my turn. the other driver never turn or slowed down and hit me on driver side of my car. he's driving with an expired license since 2003 and has insurance. my friends insurance is saying i'll have to pay for the other drivers damages if I'm held at fault..help
Since you were driving your friend's car with permission, you should be covered under your friend's insurance policy (called a permissive user). There are some exceptions - for example, you live in the same place and are listed as an excluded driver). The status of one's license, whether valid, expired or non existent, has no bearing on the issue of fault. For example, if you get rear ended and do not have a license, you are not at fault.
