Violation of visitation order

Question Details:

The custodial parent has not allowed the non-custodial visitation even when a new court order has been given. Parent/child just found after 5 yrs. please advise.

There is no motion to compel compliance with visitation orders in California. You need to either file an Order to Show Cause for Contempt or Modification or both.

Although i am not completely clear on your question essentially a custodial parent must abide by the order of the court. if the court orders visitation they must oblige or the other parent can make a motion to compel. if they still refuse they can be held in contempt. if the non custodial parent feels they are being mistreated they should make a motion with the court. there are many attorneys who can assist with this.
