What are my rights if injured during a recreational activity?
Question Details:
I was on vacation the beginning of May. On 05/04my friend and I went para-sailing for the first time. We landed after our turn but before we got our gear off I looked up and something metal hit me so hard in the face that I was knocked out. My friend and I were still attached to the parachute. Apparently, our rope broke. The parachute was detached and caught wind and dragged us off of the dock and back into the water. I woke up whenin the water and heard my friend screaming. I had a severe concussion; she had some bruises. The company won't return my e-mails to them.
If you were injured due to the fault of the company, such as poor maintenance of their supplies or equipment, poor supervision or instruction, careless stowage of equipment, using the wrong equipment, or taking you out on a day when conditions were unsafe, they might be liable you injuries and medical costs. However, if there was no fault--if they essentially did everything right, and owing to some random bad luck or freak gust of wind, the parachute was caught and pulled, then there very possibly would be no liability; liability depends generally on fault, and the fact that a person was injured without more does not, by itself, establish liability.
So if there is fault, you would have good grounds to, if necessary sue.
