Teacher/School Liability For Accident?
Question Details:
My daughter was burned at school by a teacher treating a stye in her eyelid. Hot water Dripped onto her cheek and caused burns on her cheek that where blistering within a hour. My wife took her to the Dr. and we are following treatments. I am concerned that the burns will be permanent scars on her face and my daughter may need plastic surgery. What liability does the school carry as it relates to the direct actions of the teacher? What documentation do I need to start collecting? I have a accident report, Dr forms, pics from Dr's office, etc. The teacher did call and said that she was sorry.
I am a lawyer in CT and practice in this area of the law. Teachers shold not be performing medical type treatment on students if they are not qualified. It seems that the school and the teacher are exposed to liability as a result of the teacher taking on a duty of care to your daughter resulting in harm. The school will try to disclaim liability becasue the treach was not supposed to be treating your daughter, however, the teacher was acting in furtherance of her job duties trying to help your daughter. this is a very interesting case as far as liability is concerned as the school is going to fight this. I suggest that you hire a lawyer immediately to place the school and the teacher on notice of a lawysuit. gather up all the medical bills and bring them to the lawyer, with any photos. the lawyer will liklely meet with you for free the first time and let you know if he will take the case.
