Question Details: Can an employer deduct taxes for the value of a health insurance provided to a same sex spouse? If yes, how is it valued if the member was signed up to for the employer sponsored "family plan" before the same-sex marriage (so her children would be covered). Even though her spouse is now added , the cost of the plan is still the same.
I'm sorry, but this sounds completely wrong to me, and I don't know where the employer got the idea that the health insurance for the spouse (same sex or otherwise) was taxable income. I'd double-check with a CPA, just to make sure, and then I'd demand the extra money back. And if it wasn't paid, reasonably quickly, I'd hire a lawyer and sue.
