Question: Criminal Defense - Texas

Asked on 10/1/2009
Sueing for an up charge on a price for a product.
I'm a cheerleading coach for a youth associations. I wanted to know is it against the law to charge a little more for uniforms ordering then what the price is. A company gave us a deal for 139.99 when it was cost 179.99. The parents paid the original price and got everything they paid for. They parents wrote a personal check out to me to get all uniforms. The association never gave any money on this, and never paid for the uniforms. Can the associations sue me for the price different? Or do the parents have to sue me for the price difference if they found out?

You could be prosecuted for fraud.  I doubt the parents would sue you for 40.  But a DA might be offended by this and try to prosecute you.
