Question Details: I was unable to pay my Federal student loan since I moved to Romania in 1992. Now I got a call from a Pensilvania collection agency . Can they collect the debt and how?
I am a lawyer in CT and practice in this area of the law. If you have assets in NY the loan company may get a judgment against you for nonpayment and seek to take those assets to satisfy the judgment. federal student loans unfortunately as not dischargeable in bankruptcy. therefore, you cannot file BK to rid yourself of this debt. If you no longer live in the States, and you do not intend to come back, you may not have to worry about this as the fed govt is not likely going to be able to come to romania to collect this debt. if you plan to come back to the states you will have to deal with this judgment. I suggest calling a lawyer to try to have th elawyer work out some kind of payment plan/deal to get you back on track with payments.
