I was injured when I stepped into a pothole, can I sue the town?
Question Details:
Walking home from a neighbor's house stepped in hole. I tore miiscus had it repaired but it still hurts and is swollen. I am waiting on a total knee replacement. There were numerous complaints about the condition of the road that I was injured on (mufflers front ends etc.). I used to be a carpenter but now, at age 46, I can barely walk.

In order to prevail on your case, you will likely have to prove that the city was on notice of the pot hole and had a reasonable amount of time to fix it and that the pot hole was the sole reason for your injury. I suggest that you take some pictures of the pot hole and then go see a lawyer. most lawyers will meet with you for free the first time and let you know whether they believe you have a case. your certainly have injuries, the question is notice. bring whatever evidence as to the notice the city had of the pot hole to your lawyer.
