I was injured when I stepped into a pothole, can I sue the town?

Question Details:

Walking home from a neighbor's house stepped in hole. I tore miiscus had it repaired but it still hurts and is swollen. I am waiting on a total knee replacement. There were numerous complaints about the condition of the road that I was injured on (mufflers front ends etc.). I used to be a carpenter but now, at age 46, I can barely walk.

I am a lawyer in CT and practice in this area of the the law.  In order to prevail on your case, you will likely have to prove that the city was on notice of the pot hole and had a reasonable amount of time to fix it and that the pot hole was the sole reason for your injury.  I suggest that you take some pictures of the pot hole and then go see a lawyer.  most lawyers will meet with you for free the first time and let you know whether they believe you have a case.  your certainly have injuries, the question is notice.  bring whatever evidence as to the notice the city had of the pot hole to your lawyer.
