Step parent adoption

Question Details: my sons biological dad has not tried to see or pay any court ordered child support in over 8 years, after all this time he just filed for visitations, the judge granted no visitations. my husband wants to adopt my son, can we use child abandonment in our case. my son does not know his biological dad as his dad he knows my husband as his father, as my husband has been his dad since he was 3.

Absolutely.  The fact that a judge has already ruled on the visitation, against the biological father, will definitely be helpful.  If nothing changes, between now and the time the question comes up in the adoption proceeding, about the biological father's performance or lack of the same, the answer is going to be pretty much the same, too, and that's good news for you.

I'd encourage you to go ahead, and I think having a lawyer's help would be a good idea.
