Spousal Credit Card Debt

Question Details:

I have a friend whose husband opened a credit card account in his name and ran up a large debt. The card is supposedly in his name only. Is she responsible for the debt? They are still married and not planning to divorce or separate.

Bankruptcy Law Answers

She isn't directly liable.  But if the credit card company sues and gets a judgment against her husband, they would be able to reach any money she had in joint bank accounts with him, and similar assets. And, if he dies before her, with this debt outstanding, it would have to be paid out of his estate.
